1. Purpose and Scope
This Policy describes how WayKind™ / Wholesale Hotels Group LLC ("WayKind™," "we," "us," or "our") collects, uses, stores, and protects personal information obtained through the website www.way-kind.com and related online services (the "Service").
By using the Service, you acknowledge and agree that your data will be processed in accordance with this Policy and the laws of the United States and the State of Wyoming.
This Policy applies to all users of the Service, including travelers, supporters, and nonprofit participants, and governs data collected both directly and automatically.
WayKind™ is a U.S.-based service. Only nonprofit organizations formed in the United States are eligible to enroll in our program, and individuals participating as referral partners or influencers must be U.S. citizens or residents or acting through U.S.-based entities. Travelers from outside the United States may use the Service to support participating U.S. nonprofits, but the Service is not directed to non-U.S. organizations, and all personal data is processed in the United States in accordance with this Policy.
2. Information Collected
We collect only the personal information required for lawful business and operational purposes and retain it only as long as necessary.

Sensitive personal data is not intentionally collected except as required for nonprofit identity verification via third-party providers.
2A. Referral and Nonprofit Tracking Data
The WayKind™ platform includes a referral mechanism that attributes new user registrations to specific nonprofits.
When a user signs up through a nonprofit's referral link or banner, that nonprofit becomes the user's default designated organization for commission allocation.
WayKind™ records limited referral data (such as nonprofit ID, referral code, registration timestamp, and referring URL) for this purpose.
Users who register directly through WayKind™ (without a nonprofit referral) may freely select any enrolled nonprofit in their account settings.
Users who register through a nonprofit referral link and later wish to support another nonprofit must create a new account not associated with the original referral.
Referral identifiers are used solely for internal tracking, attribution, and fraud prevention. They are not used for marketing, profiling, or resale.
Referral data is treated as personal information and protected with the same safeguards described in this Policy.

Nonprofits displayed on or linked through the WayKind™ platform operate independently and maintain their own privacy practices. WayKind™ is not responsible for, and does not control, how those organizations manage user information.
3. Third-Party Service Providers
WayKind™ engages independent service providers under written agreements requiring appropriate data protection, including but not limited to:
- Stripe, Inc. (USA) – payout and transaction processing
- Docuseal (USA) – electronic signature management
- Markets ProLive 360 S.L. (Spain) – biometric identity verification
- Vercel, Inc. (USA) – cloud platform and hosting (AWS-based global infrastructure)
These entities act as independent data processors and may process data solely to perform contracted functions under their own privacy policies.
4. Lawful Basis and Use of Information
Personal information may be collected and processed for the following legitimate purposes:
- Operation, maintenance, and improvement of the Service
- Verification of users and enrolled nonprofits
- Transaction and payout processing
- Referral tracking between users and nonprofits
- Security, fraud detection, and prevention
- Compliance with legal obligations and dispute resolution
- Analytics and performance monitoring
WayKind™ collects and processes personal information only to the extent necessary to fulfill these business purposes and does not retain data longer than required.
WayKind™ does not sell, lease, or exchange personal information (including under the meaning of the California Consumer Privacy Act (CCPA) or similar state laws).
5. Data Disclosure
WayKind™ may disclose personal information only:
- To authorized service providers under confidentiality obligations;
- To competent authorities pursuant to lawful process (including the U.S. CLOUD Act);
- As reasonably necessary to protect legal rights, safety, or property; or
- In aggregated or de-identified form for analytics or reporting purposes.
6. Data Retention
Data is retained only for the period necessary to accomplish the purposes described or to satisfy legal, accounting, or regulatory obligations.
After expiration of applicable retention periods, data is securely deleted or anonymized.
7. User Rights and Requests
Where required by law, users may request to:
- Access or correct certain personal information;
- Request deletion of personal data where legally permissible;
- Obtain details about the categories of personal data processed.

8. U.S. State Privacy Rights (California, Virginia, Colorado, Texas, and Others)

WayKind™ does not "sell" or "share" personal data as defined under state privacy laws, and we do not use personal data for targeted advertising.

9. Cookies and Analytics
WayKind™ uses essential and analytical cookies to operate its website and gather usage metrics. Marketing or profiling cookies are not deployed.
Referral links or nonprofit banners may use small first-party cookies or URL parameters to record which nonprofit referred a user for attribution purposes only. (For more detail, see our separate Cookie Policy on the website.)
10. Security Measures
WayKind™ implements reasonable administrative, technical, and organizational controls, including:
- TLS/SSL encryption in transit
- Encryption of credentials at rest
- Multi-factor authentication for administrative access
- Continuous infrastructure monitoring
- Access restrictions based on least-privilege principles
While we maintain commercially reasonable security practices, no system can guarantee absolute protection. Users accept this inherent risk when using the Service.
11. Breach Response
In the event of a security incident involving personal data, WayKind™ will promptly investigate, take appropriate corrective action, and notify affected parties and regulators where required by law.
12. Children's Privacy
The Service is intended solely for users aged 18 or older.
WayKind™ does not knowingly collect personal information from children under 13. (If we become aware that a child under 13 has provided personal data, we will delete it in accordance with applicable law.)
13. International Transfers
Data may be stored or processed in the United States (primarily), Spain, and other countries where our service providers operate (due to our global hosting infrastructure).
All such international data transfers are safeguarded by lawful mechanisms. For example, our hosting provider is certified under the EU-U.S. Data Privacy Framework, ensuring adequate protection for personal data transferred from Europe. Transfers are further protected by standard contractual and technical measures in accordance with applicable law. Note: WayKind's hosting platform (Vercel) utilizes Amazon Web Services data centers across numerous global regions. Vercel may route user data to the nearest server for performance and redundancy, and may process data in the U.S. or any country where it or its sub-processors operate. Vercel's participation in the EU-U.S. Data Privacy Framework provides assurance of adequate data protection for cross-border transfers.
If WayKind™ expands services to users outside the U.S., we will provide supplemental regional privacy notices to comply with local laws.
14. User Representations and Responsibilities
Users represent and warrant that all information submitted to WayKind™ is truthful, accurate, and lawfully obtained, and that they will not upload or transmit any unlawful, infringing, or harmful material.
Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their accounts. Please notify us immediately of any unauthorized use of your account.
15. Disclaimer of Warranties
The Service (including all content, features, and data processing operations) is provided "as is" and "as available," without warranties of any kind, express or implied. WayKind™ expressly disclaims any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee continuous or error-free service, and downtime, interruptions, or errors may occur without notice.
16. Limitation of Liability
To the fullest extent permitted by law:
- Maximum Liability: WayKind™ (Wholesale Hotels Group LLC) and its officers, directors, employees, agents, affiliates, and contractors shall have a maximum aggregate liability of one hundred U.S. dollars (USD $100) or the total amount you paid (if any) to use the Service in the twelve months preceding the claim, whichever is less.
- No Indirect Damages: In no event shall WayKind™ or its affiliates, officers, employees, or agents be liable for any indirect, incidental, special, punitive, or consequential damages of any kind (including lost profits, lost data, business interruption, or loss of goodwill) arising out of or in connection with the Service or this Policy, even if advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so certain limitations above may not apply to you. In such cases, liability is limited to the minimum extent required by law.
17. Indemnification
Users agree to indemnify, defend, and hold harmless WayKind™ (Wholesale Hotels Group LLC) and its owners, officers, directors, employees, agents, affiliates, and contractors from and against any and all third-party claims, losses, liabilities, damages, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) the misuse of the Service; (b) the submission of false, misleading, or unlawful information; or (c) any other violation of this Policy or applicable law by the user.
18. Force Majeure
WayKind™ shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control. This includes, without limitation, acts of God, natural disasters, fire, flood, epidemic, explosion, war, terrorism, civil unrest, strikes or labor disputes, internet or power outages, attacks on our systems (such as DDoS attacks or other cyberattacks), or actions of governmental authorities. In any such event, our obligations will be suspended for the duration of the event, and we will use reasonable efforts to resume service as soon as practicable.
19. Dispute Resolution and Governing Law
Arbitration: All disputes, controversies, or claims arising out of or relating to the Service or this Policy shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. This arbitration agreement is governed by the U.S. Federal Arbitration Act (FAA). Arbitration shall be conducted in English by a single neutral arbitrator, either remotely (e.g. via video conference) or in Sheridan County, Wyoming, as mutually agreed or as determined by the arbitrator. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.
Costs: Each party shall bear its own arbitration costs and attorneys' fees, unless the arbitrator expressly awards costs or fees to the prevailing party.
Class Action & Jury Waiver: By using the Service, you waive any right to participate in a class action, class-wide arbitration, or other representative proceeding against WayKind™. All claims must be brought solely on an individual basis. You also waive any right to a trial by jury in any lawsuit that might arise between you and WayKind™ (in the event, for example, that this arbitration agreement is found unenforceable).
Governing Law: This Policy and any disputes arising from it are governed by the laws of the State of Wyoming, U.S.A., except to the extent that the Federal Arbitration Act governs the arbitration clause. This governing law applies regardless of conflict-of-law principles. If a dispute is found not subject to arbitration, you agree to submit to the personal jurisdiction of the state or federal courts located in Wyoming for resolution.
20. Policy Updates
WayKind™ may amend this Privacy & Data Protection Policy from time to time. When we make changes, we will update the "Last Updated" date at the top of this Policy. In the case of material changes, we may also provide notice to registered users via email or by posting a prominent notice on our website.
Your continued use of the Service after any updated Policy has been posted (and after any required notice) will signify your acceptance of the revised terms. We encourage you to review this Policy periodically for any updates.
